TERMS OF SERVICE OF THE E-CMR.EU WEBSITE

I. GENERAL PROVISIONS

These Terms of Service set out the rules for using the website available at https://www.e-cmr.eu ("Website").

The owner and operator of the Website is Trans Assist Sp. z o.o. with its registered office in Kielce, ul. Żniwna 21, 25-419 Kielce, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Lublin-Wschód in Lublin, 6th Commercial Division of the National Court Register, under KRS number 0000805737, NIP 9462691960, REGON 384448444 ("Service Provider").

These Terms of Service constitute the terms of service referred to in Art. 8 of the Act of 18 July 2002 on the Provision of Electronic Services (consolidated text: Journal of Laws of 2020, item 344).

Every person using the Website ("User") is required to read these Terms of Service before using the Website. Use of the Website constitutes acceptance of the Terms of Service.
II. TYPE AND SCOPE OF SERVICES PROVIDED ELECTRONICALLY

Through the Website, the Service Provider provides the following services electronically:
a. CMR document generation – a service consisting of providing the User with an interactive form, the completion of which enables the generation of an international CMR consignment note in PDF format;
b. Newsletter – a service consisting of sending commercial and educational information electronically regarding transport, logistics, transport documents and Trans Assist services, to the e-mail address provided by the User;
c. Informational content – a service consisting of providing Users with educational and informational materials regarding CMR documents, international transport and legal regulations in this area;
d. Contact form – a service consisting of providing the User with an interactive contact form, the completion of which enables the User to send an inquiry to the Service Provider. As part of the contact form, the User provides the following data: first name, surname, phone number, e-mail address and message content.

The services provided through the Website are free of charge.

Use of the CMR document generation service does not require account registration or login.

Use of the contact form requires providing the data indicated in section 1(d) above. Providing this data is voluntary but necessary to submit an inquiry and receive a response from the Service Provider.
III. CONDITIONS FOR THE PROVISION OF ELECTRONIC SERVICES

To use the Website, the following technical requirements must be met:
a. a device with Internet access (computer, tablet, smartphone),
b. a web browser in its current version (e.g. Google Chrome, Mozilla Firefox, Microsoft Edge, Safari) with JavaScript and cookies enabled,
c. an active Internet connection,
d. in the case of the Newsletter service – an active e-mail address.

The Service Provider makes every effort to ensure the Website is available continuously; however, it does not guarantee uninterrupted operation. The Service Provider reserves the right to temporarily suspend the availability of the Website in whole or in part, in particular for the purpose of carrying out maintenance work, updates or bug fixes.

The Service Provider shall not be liable for technical problems resulting from the User's failure to meet the technical requirements set out in section 1.
IV. RULES FOR USING THE CMR DOCUMENT GENERATION SERVICE

A User using the CMR document generation service is required to:
a. enter true, reliable and up-to-date data into the form,
b. use the Website in accordance with its intended purpose and applicable law,
c. refrain from actions that may disrupt the proper functioning of the Website.

Responsibility for the content of the CMR document. The Service Provider only provides a technical tool enabling the generation of a CMR document based on data entered by the User. The User bears sole responsibility for the correctness, completeness and legality of the data entered into the form. The Service Provider does not verify the truthfulness or correctness of data entered by the User.

The generated CMR document constitutes a printout of the form completed by the User. The User should independently verify the compliance of the generated document with applicable law.

The Service Provider shall not be liable for legal, tax, customs or other consequences arising from the use of a CMR document generated through the Website.

It is prohibited to use the Website for purposes contrary to law, in particular for the purpose of generating documents containing false, fictitious or misleading data.
V. NEWSLETTER

The User may voluntarily subscribe to the Newsletter service by providing their e-mail address.

Subscribing to the Newsletter constitutes consent to receive commercial information electronically within the meaning of the Act of 18 July 2002 on the Provision of Electronic Services.

The User may unsubscribe from the Newsletter at any time by clicking the unsubscribe link included in each Newsletter message or by sending a relevant notification to: [email protected].

The Newsletter service is provided using the SendPulse Inc. platform. Details regarding the processing of personal data within the Newsletter are set out in the Website's Privacy Policy.
VI. INTELLECTUAL PROPERTY

All content published on the Website, including texts, graphics, logos, icons, page layout and software, is the property of the Service Provider or entities from which the Service Provider has obtained appropriate licenses, and is protected under copyright and industrial property law.

Use of the content published on the Website is permitted only within the scope of permitted personal use. Copying, modifying, distributing or using the Website's content for commercial purposes without the prior written consent of the Service Provider is prohibited.
VII. COMPLAINTS

The User has the right to submit a complaint regarding the functioning of the Website or the services provided through it.

Complaints should be sent to the e-mail address: [email protected] or in writing to the registered office address of the Service Provider.

A complaint should contain at least:
a. the User's contact details (e-mail address),
b. a description of the problem constituting the basis of the complaint,
c. the expected manner of resolving the problem.

The Service Provider shall consider the complaint within 14 days of its receipt and shall inform the User of the manner of its resolution electronically to the e-mail address provided.
VIII. FINAL PROVISIONS

The Service Provider reserves the right to amend these Terms of Service. The Service Provider shall inform Users of any changes through an appropriate notice on the Website. Changes shall enter into force within the period indicated in the notice, which shall be no shorter than 7 days from the date of its publication.

In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services and the Act on Consumer Rights.
